We have set out below the terms and conditions which apply to information shown in the pages of 5b’s e-commerce facility ("the website") and to the ordering of any products from the website.

3. Website Information
a) We have tried to ensure that information provided in the website is accurate. However, we make no representation and give no warranty of any kind in respect of the information.

b) We do not accept liability for any loss (direct, indirect or consequential) which may arise from reliance on information contained in the website or in respect of any error or omission, except in relation to death or personal injury caused by our negligence.

4. Description of Products
a) The description and specification of products in the website is only approximate and we reserve the right to make changes which do not materially affect the quality or performance of those products.

b) We may correct any error appearing in the website or withdraw any product from sale without incurring liability. Price and availability is also subject to change without notice.

5. Price and Payment
a) The price of the item/s will be the price quoted in the website at the time we accept your order.

b) Payment is taken via Shopify or Paypal at the time we accept your order. The credit and debit cards we accept are listed in the website at the time you place your order. Refunds will generally be made by means of a credit to your electronic payment account.

6. General
a) The Contracts (Rights of Third Parties) Act 1999 shall not apply to any contract between us, so that no contractual rights are conferred on third parties.

b) Any contract between us shall incorporate these terms and conditions and be under Scottish law. If there is any dispute, the Scottish Courts will have exclusive jurisdiction.

7. Regulation
Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.

8. BREXIT UPDATE
EU Customers, due to the UK/EU Trade deal, new legislation and application of tariffs/VAT charges may now be applied at the point of entry to your Country.

These are in addition to P+P costs paid to ship your items. Customers in the EU are now 'importing' items from the UK and legislation dictates that tariffs and taxes must be applied when goods enter the EU market from the UK.

You can expect to pay a 20% VAT charge on your total shipment a 12% Customs Duty along with an additional courier handling fee.

Please note these charges vary from country to country within the EU and we would therefore advise you please check with your local customs office what duty charges may be applied.

9. Cancellation and Returns
If for any reason you are not completely satisfied with your purchase, we will gladly exchange or refund your items (excluding made-to-order items) within 7 days of receipt, provided that:
a) We are emailed to register your wish to exchange or return your item
b) We receive the return within fourteen days of purchase
c) The item is returned in its original condition — unworn, unused, unwashed, undamaged etc
d) The return is posted in the package in which it was received, or an equally secure package
e) If the item was a gift, the name of the purchaser must be noted
f) Failure to meet these requirements may result in delays in processing the return or receipt of the package by us
Please note, sale and pre-order items can be returned for store credit only. Please also note that we do not refund original shipping costs or any duties or taxes incurred in a purchase.

We will then be in touch with you to provide you with the return instructions which state that you are free to send back the item via your own method, as long as the above criteria is met. Please be advised that as we are a small organisation, we are unable to offer free returns. We recommend using a tracked service and keeping proof of postage for your return to ensure we receive the item. We cannot complete a return or refund if the item is lost whilst being returned to us.
